The www.xculpter.com retail website (hereinafter referred to as “Site”) is an e-commerce site accessible via the internet network and available to all end users (hereinafter referred to as “Surfers”) of that network. It is published by the company SweetLisS SLNE (hereinafter referred to as “SweetLisS SLNE”), a limited company with capital of 3.012 euros, headquartered at La Hoya, Poligono 1, n° 68 - 03294 ELCHE - Spain and registered in the Alicante Registry of Trade and Companies under number B54772975 N° intracommunity VAT: ESB54772975 .
SweetLisS SLNE offers for sale on its Site, textile products and accessories (hereinafter referred to as the "Products"), that are manufactured by SweetLisS SLNE or its possible commercial partners, to users browsing on the Site (hereinafter referred to as “Customers”). For the purposes of these General Terms and Conditions, it is agreed that the Customer and SweetLisS SLNE shall be referred to jointly as the Parties and individually as the Party.
It is stipulated that only persons who are at least 18 years of age and have the status of consumers and full legal capacity, are allowed to purchase Products on the Site.
All orders of a Product offered on the Site imply the Customer’s fully acceptance of these general terms and conditions.
SweetLisS SLNE reserves the right to change these General terms and Conditions of Sale at any time by publishing a new version on the Site. The applicable General Terms and Conditions of Sale are those that are in effect on the Site on the date of placement of the order.

ARTICLE 1 - PURPOSE:
These General Terms and Conditions of Sale govern the Parties’ rights and obligations with respect to the online sale of Products offered on the Site. Along with the summary purchase order and the invoice transmitted to the Customer, they constitute the entirety of contractual documents and apply to the exclusion of any others.
In the event of conflict or divergence between the terms of these three documents, the documents shall prevail in the following order:
- the invoice
- the summary purchase order, and
- these General Terms and Conditions of Sale.
ARTICLE 2 - PRODUCTS - PRICES:
Only Products displayed on the Site on the day it is consulted by the Customer are offered for sale. To that end, the Customer is advised upon placement of his order, as to whether the Products he selects are available. If he has questions regarding the unavailability of a Product, the Customer may contact the e-boutique Customer Service Department by clicking on « Contact». However, in the unusual circumstance that a Product becomes unavailable after confirmation of the order, the Customer is advised by email within five working (5) days after confirmation of the order.
The photographs illustrating the displayed Products reproduce them as precisely as possible. However, the Customer is advised to consult the description of each Product in order to know its essential characteristics.
The prices are stated in Euros with all taxes included, with the preparation and delivery costs being billed in addition thereto. The prices charged are those appearing on the Site at the time of the order.
The delivery cost is transmitted to the Customer in the summary purchase order, prior to the confirmation thereof.
ARTICLE 3 - ORDER:
3.1. Order registration
Each new Customer must fill out the spaces reserved for the creation of his profile, which are accessible in the « My Account » rubric. The Customer must precisely fill out the form that is made available to him, in which he must provide the information necessary for his identification, such as an electronic address and a password of his choice (which will remain personal and confidential), in order to subsequently identify himself on the Site. A Customer that already has a Customer account must identify himself after clicking on « Continue your order », by entering his electronic address and password.
The Customer agrees that the entry of these two identifiers constitutes proof of his identity.
The provision of nominative personal data collected in the context of online sales and marked with an asterisk is mandatory, as this information is necessary for the processing and delivery of orders, as well as for the issuing of invoices. They remain strictly confidential and are processed in accordance with SweetLisS SLNE’ Confidentiality Policy, which is published on the Site.
A Customer, who wants to place an order, selects the Product (s) of his choice by clicking on « Add to Cart ».
At any time the Customer may:
- verify the number of Products contained in his basket and obtain detailed information on each of them by clicking on « Cart »;
- continue his choice of Products by clicking on « Continue shopping »,
- end his order by clicking on « Proceed to Checkout ».
3.2. Order confirmation
After becoming aware of the summary purchase order, the Customer clicks on the chosen payment method to confirm his order and pay for it.
Confirmation of the summary purchase order by clicking on the chosen payment method constitutes the Customer’s consent. This consent is deemed a handwritten signature and serves as proof of the conclusion of a contract between the Parties, the entirety of the order, and the payment of the amounts due for said order SweetLisS SLNE may refuse to accept the order in the following cases:
- Suspicion of fraud.
- Abusive exchanges and returns as described in article 8 hereinafter.
- Customer’s failure to pay for any part of a previous order.
- Authorization for payment by bank card refused by banks.
The price owed by the Customer is the amount indicated in the summary purchase order, of which the Customer took cognizance prior to confirming his order.
The Customer pays for his order by bank card (Visa, Eurocard/Mastercard) or via PAYPAL or in accordance with the provisions of this article.
To pay for his order by bank card, the Customer must transmit his bank card number and, according to the type of the card, its expiration date and the cryptogram number (the 3 numbers appearing on the back of his bank card).
The card is debited upon confirmation of the order on the Site, unless the server is unavailable.
It is specified that, to pay by bank card, the Customer is automatically transferred to the Banque Populaire SystemPay server. Banque Populaire SystemPay server is secured by encryption S.S.L 3.0 (Secure Socket Layer) to protect all of the data related to means of payment. Banque Populaire SystemPay supervises its platform and the transactions that are submitted to it 24 hours a day, 7 days a week. It is specified that the Customer’s bank data do not go through SweetLisS SLNE’ computer service at any time.
However, in the event of fraudulent use of the Customer’s bank card, as soon as the Customer becomes aware of such a use -- and after advising his bank to stop payment -- he is asked to contact the e-boutique Customer Service Department, which tell him what to do:

If a Product is unavailable after confirmation of the order, as specified in article 2.1 hereinabove, and the payment has already been made, the Customer will be refunded the amount of the payments, which will occur as promptly as possible and, in any event, within fourteen calendar (14) days after payment of his order.
3.3. Acknowledgement of receipt – order confirmation
After payment, SweetLisS SLNE promptly – i.e. prior to delivery at the latest -- transmits a summary document of the order to the Customer by email to the address indicated by the Customer.
The purchase order is recorded in SweetLisS SLNE’s registries, which are kept on reliable and durable medium. The Customer agrees that the purchase order constitutes proof of the contractual relationships between the Parties.
The Customer may print the summary purchase order transmitted with the acknowledgement of receipt. The summary order is also available in « My Account ».
ARTICLE 4 - DELIVERY :
SweetLisS SLNE makes all necessary arrangements to have the order delivered within an average of five (5) to ten (10) business days and, in any event, commits that the delivery will be made within a maximum of fifteen (15) business days following payment for the order. It is specified that the orders registered on the Site after 1:00 p.m. (Paris Time) on Friday, or on Saturday or Sunday, will be processed on the following Monday. Orders registered on the Site on a holiday will be processed on the following business day.
The Products ordered by the Customer are delivered at the address indicated by the Customer, along with the delivery slip and the invoice. The Customer may have the Products delivered to an address other than his own.
Delivery might not occur in the event of force majeure as defined in article 10.1 hereinafter.
At the time of placing his order, the customer must choose on the e-boutique site the place of delivery.
SweetLisS SLNE endeavors to deliver your Products within the timescales of the chosen delivery means. However, SweetLisS SLNE is unable to guarantee that they will not be affected by unforeseen issues affecting our carrier. Under these circumstances, SweetLisS SLNE does not issue any form of compensation.
Customer’s order will be fulfilled by the delivery date set out in the dispatch confirmation email or, if no delivery date is specified, then within 30 (THIRTY) days of the date of the dispatch confirmation email, unless there are exceptional circumstances. The Products will be at Customer’s risk from the time of delivery of the Products to the Customer.
ARTICLE 5 - RECEIPT OF PRODUCTS:
Upon receipt of the Products, it is up the Customer to verify that they are in conformity with his order. Any abnormality with respect to delivery (such as missing or damaged Products, Products that are not in conformity with the order, damaged packages) must be notified without delay to SweetLisS SLNE’ Customer Service Department, by any of the following means:

In the event of abusive complaints, SweetLisS SLNE may refuse a subsequent order.
The Customer has the option of requesting SweetLisS SLNE to repair the Products if technically feasible or to replace them, unless one of these options is objectively disproportionate or impracticable.
SweetLisS SLNE reserves the right to require that the Customer return the nonconforming or damaged Product pursuant to Article 6.
ARTICLE 6 - RIGHT OF CANCELLATION:
The Customer has fourteen calendar (14) days from the date of receipt of the Product to exercise his/her right of cancellation. To that end, the Customer shall submit the cancellation form provided by SweetLisS SLNE duly filled out. Within fourteen (14) calendar days from the reception of the Products by the Customer, the Customer shall return, at its cost (Postage prices to Spain or France) the Products. The consumer is well aware that the return of the Products must be done to Spain or France.

In order to be returned, the Products must not have been worn or washed.
It is your responsibility to keep all return receipts, making a shipment by registered mail or by any other means necessary to enable a precise proof of the sending date.
The refund will be made on the means of payment which has been used to pay the order
If the aforesaid conditions are met, SweetLisS SLNE will reimburse the Customer for the total amount of his order (delivery cost excluded) as soon as SweetLisS SLNE receives the Products or as soon as the Customer provides SweetLisS SLNE with evidence of having sent back the Products, whichever is the earliest.
ARTICLE 7 - LIABILITY AND WARRANTY:
All of the Products are covered by the legal warranty of conformity specified in the applicable law.
SweetLisS SLNE assumes no liability whatever for inconveniences or injury due to use of the internet network, such as disconnection of the service or the presence of computer viruses.
ARTICLE 8 – CONTRACTUAL WARRANTY:
In addition to the legal warranty, SWEETLISS SLNE warranties the functioning of our products against all defaults of manufacturing and components for a period indicated on the product page starting at the date of your receipt of the related products.
To benefit from the warranty, the Customer needs to provide Sweetliss SLNEwith a proof of its purchase and the date of purchase.
This warranty does apply to any defect in the products arising from:
(a) fair wear and tear;
(b) wilful damage, abnormal storage or working conditions, accident, negligence by you or by any third party;
(c) if you fail to operate or use the Products in accordance with the user instructions; and
(d) any alteration or repair by you or by a third party.
This warranty is in addition to your legal rights under the Spanish laws.
In no case, this warranty can give right to indirect damages.
The contractual warranty includes spares parts and labor.
The Customer may contact the e-boutique Customer Service Department, which will tell him what to do and to which address to return his product by email : email@example.com.
Although SweetLisS SLNE cannot commit to do so, it will try to provide a return address in the country of the Customer.
ARTICLE 9 - CONFIDENTIALITY:
To make purchases on the Site, the Customer must create an account and choose an electronic address and a password that will be requested every time he wants to enter his account. The Customer’s personal data are thus protected by a password to which he alone has access. SweetLisS SLNE advises the Customer not to disclose it to anyone.
Also, the Customer must not forget to disconnect himself from his profile and close the window of his browser at the end of his working session, especially if the Customer uses a computer shared with others for access to the web. These precautions will prevent other users from having access to his personal data.
The Customer has sole responsibility for keeping his password confidential, and he alone bears any consequences that might result from any use of said password by third parties.
ARTICLE 10 - MISCELLANEOUS STIPULATIONS:
10.1 Force majeure
SweetLisS SLNE assumes no responsibility for late performance, or for total or partial nonperformance, of its obligations specified herein, if such a delay or nonperformance is due to an event of force majeure, such as total or partial disturbances or strikes of postal services or means of transport and/or communication, floods or fires; and SweetLisS SLNE shall advise Customers of the occurrence of any such event within five (5) business days thereafter.
SweetLisS SLNE shall extend every effort to inform the Customer as promptly as possible of the modes of processing his order during the duration of the event of force majeure.
Should the event of force majeure last more than one (1) month, the Parties shall be freed from their obligations to each other. As appropriate, SweetLisS SLNE shall reimburse the Customer as promptly as possible for orders that have been paid but not delivered.
10.2. Partial validity
Should any of the paragraphs or provisions of these General Terms and Conditions of Sale be deemed null and void or unenforceable, the remaining provisions shall remain in effect, unless the invalidated obligation is of such a nature that its elimination or invalidation would prevent pursuit of these General Terms and Conditions in their entirety.
The fact that SweetLisS SLNE does not at a particular time, require execution of any of these General Terms and Conditions of Sale, or exercise any right conferred on it thereby, shall not under any circumstance be deemed a definitive waiver of that right or prevent it from subsequently insisting upon execution of such contractual obligations, regardless of the duration of its abstention from doing so.
10.4. Conservation and filing of transactions
The filing of invoices is effectuated on a reliable and durable medium in such a way that it corresponds to an accurate and durable copy.
ARTICLE 11 - APPLICABLE LAW AND JURISDICTION:
Save to the extent that you exercise your right as a consumer to bring an action in or rely on the laws of your country of domicile, the interpretation, construction, effect and enforceability of these General Terms and Conditions of Sale shall be governed by SpanishLaw, and you and we agree to submit to the non-exclusive jurisdiction of Spanish courts for the determination of disputes.
The Parties nevertheless agree to attempt to resolve the problem by private means prior to any legal action.
